10) Force Majeure:
The Company shall not be liable for any failure to perform its obligations where such failure has resulted due to Acts of Nature including fire, flood, earthquake, storm, hurricane or other natural disaster, war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity, any type of redirection by Government (Central, State, and/or Local Authority etc.,) any type of change in Law, Act by Government (Central or state).
11) Jurisdictional Issues:-
In case of any dispute arising between the parties herein with respect to the terms and conditions of this agreement, the same shall be referred to arbitration of a common arbitrator if agreed upon, failing which to two arbitrators one to be appointed by each party to the dispute and the arbitration shall be governed by the Arbitration and the Conciliation Act, 1996. The Place of Arbitration shall be at Bengaluru.
